DEFYING GRAVITY

Terms of Service

Effective 13 October 2026

These terms are an agreement between you and Joshua van der Merwe ("we", "us") for the use of the Defying Gravity app. By using the app you agree to them.

1. What the app is

Defying Gravity is a journal. You log short video attempts of calisthenics skills, and the app organises them into a timeline, a calendar and a side-by-side comparison so you can see how you have changed over months.

It is not a coach and not a medical service. Nothing in the app is training advice or medical advice. Calisthenics skills carry real risk of injury — how you train, and whether a movement is safe for you, is your decision and your responsibility. If in doubt, consult a qualified coach or a medical professional.

2. Your account

You need an account to use the app. Keep your sign-in details to yourself; you are responsible for activity under your account. You must be at least 13 years old. If you are under 18, you may use the app only with the consent of a parent or guardian.

You can delete your account at any time from Settings → Your data → Delete account. We may suspend or close an account that is being used unlawfully or to abuse the service.

3. Your videos and your journal stay yours

You keep all rights in the videos you film and everything you write. We claim no ownership of them.

You grant us only the narrow permission we need to run the service for you: to store the journal metadata you enter on our servers so it survives reinstalling the app, and to transmit it back to your devices. In this version we do not upload, copy, host, publish, display or analyse your video files at all — they stay on your phone.

The original file in your camera roll is never modified, re-encoded or deleted by this app, anywhere in the process.

4. What the app does on your device

The app makes its own copies of the clips you log so your journal survives your camera roll being cleared, and stores them in its private storage on your phone. Those copies are deliberately excluded from iCloud and system backups.

This means device-only storage is exactly that. In this version your videos exist on this phone and in your camera roll, and nowhere else. If the phone is lost, stolen, wiped, or the app is uninstalled, the app's copies are gone. We cannot recover them for you, because we never had them. Keep your own backups of footage that matters to you.

5. Price

Defying Gravity is free in this version. There are no in-app purchases and no subscriptions. If that changes in a future version, the terms of any paid plan will be presented to you before you are asked to pay, and you will never be charged without your explicit purchase.

6. Acceptable use

Don't use the app to break the law, to store content you have no right to, to interfere with the service or other users, or to attempt to access systems or data that are not yours. Don't reverse-engineer or redistribute the app except where the law expressly allows it.

7. Availability and changes

We may update, change or discontinue parts of the app. We try not to break things you rely on, but the service is provided as it is. If we discontinue the service we will give reasonable notice so you can export your journal.

8. Disclaimers and limits

The app is provided "as is", without warranties of any kind, to the fullest extent the law allows. We do not warrant that it will be uninterrupted or error-free, or that data stored on your own device cannot be lost.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, for lost footage, or for injury arising from your training. Nothing here excludes liability that cannot lawfully be excluded — including, where applicable, your rights under South Africa's Consumer Protection Act, 2008.

9. Governing law

These terms are governed by the laws of the Republic of South Africa, and disputes will be dealt with by the South African courts, unless the law where you live gives you the right to bring a claim locally.
